INTRODUCTION
These Terms and Conditions (“Terms”) set forth the legally binding agreement between the customer (“Customer”) and American Car Wash Solutions (“ACWS,” “we,” “our,” or “us”) regarding participation in the Pre-Show Specials promotion as advertised in connection with The Car Wash Show – Booth #1883. By placing an order or otherwise engaging in the promotion, the Customer agrees to be bound by these Terms.
PROMOTIONAL PERIOD
The promotional offers are valid beginning on the date of publication of the associated marketing materials and will expire at 11:59 PM Eastern Time on April 20th (“Promotional Period”). Orders must be finalized and deposits received by this deadline to qualify.
PROMOTIONAL OFFERS
Subject to the terms and conditions herein, eligible Customers may receive the following benefits:
- Free Freight: On all tunnel equipment orders with a minimum deposit of $20,000.
- 20% Discount: Off the list price of qualifying equipment purchases.
- $1,000 Discount: Toward branding and marketing services.
- 10% Discount: On all custom signage.
Offers may not be combined with any other promotions unless explicitly stated in writing by ACWS.
ELIGIBILITY
This promotion is open to commercial customers who place qualifying orders directly with ACWS during the Promotional Period. ACWS reserves the right to verify eligibility and reject any orders that do not meet the specified criteria.
DEPOSIT AND PAYMENT TERMS
To qualify for the Free Freight offer, a non-refundable deposit of $20,000 USD must be received by ACWS no later than April 20th. Full payment terms, including final balances and payment schedules, will be outlined in the applicable purchase agreement.
SHIPPING AND DELIVERY
Free freight applies solely to tunnel equipment orders meeting the deposit requirement and placed within the Promotional Period. Delivery dates are subject to availability and scheduling. ACWS will coordinate freight logistics in good faith but assumes no liability for shipping delays beyond its control.
BRANDING & SIGNAGE DISCOUNTS
The $1,000 discount for branding/marketing services and the 10% discount on custom signage apply only to services or products ordered during the Promotional Period. These discounts are non-transferable and may not be redeemed for cash or credit.
CANCELLATIONS AND MODIFICATIONS
ACWS reserves the right to cancel or modify this promotion at any time, without notice, for any reason, including but not limited to pricing errors, product availability, or unforeseen market conditions. Customer cancellations are subject to applicable restocking fees and forfeiture of the deposit if stipulated in the purchase agreement.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, ACWS shall not be liable for any indirect, incidental, special, or consequential damage resulting from or related to participation in this promotion or the use of any products purchased. ACWS’s total liability shall not exceed the amount paid by the Customer under the applicable order.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in Westchester County, New York.
